– On September 26, 2023, a fresh clash occurred in a village near the border.

– This clash occurred in the Lapangap village situated on the border between the West Jaintia Hills district of Meghalaya and the West Karbi Anglong district of Assam. There are no reports of anyone being injured in this incident.
– Both state police teams visited the scene and brought the situation under control after calming down the local residents.
– However, tensions remained high as the police forces of both states prevented villagers from gathering at the location of the clash.
– The Chief Ministers of both states will hold a meeting in October to address this issue.
Violent Clash in 2022:
– Incidents of violence like this have been recurring between Assam and Meghalaya.
– In 2022, a deadly clash occurred in a disputed area on the border, resulting in the deaths of at least six people, including five from Meghalaya and one from Assam.
Assam-Meghalaya Border Dispute:
– Border disputes between Assam and Meghalaya have been ongoing.
– Meghalaya was carved out of Assam in 1972.
The demarcation of the boundaries was done according to the Assam Reorganization (Meghalaya) Act of 1969.
– Since then, there has been a difference in the interpretation of the boundaries, leading to disputes between the two states.
Assam’s Disputes with Other States:
– Apart from Meghalaya, Assam also has border disputes with Arunachal Pradesh, Mizoram, Nagaland, and Manipur.
Resolution in March:
– Assam and Meghalaya reached an agreement on March 29, 2022, to resolve border disputes.
– Both states resolved issues in 12 of the 29 disputed sectors along their 885-kilometer border.
– At that time, the Chief Ministers of Assam, Himanta Biswa Sarma, and Meghalaya, Conrad Sangma, signed the agreement in the presence of Union Home Minister Amit Shah.
– This agreement resolved nearly 70% of the border disputes between the two states.
Inner Line Permit (ILP) System:
– According to several media reports, the Inner Line Permit (ILP) system is also a major cause of border disputes between Assam and at least four other states.
– Arunachal Pradesh, Nagaland, Mizoram, and Manipur have the ILP system in place.
– Without this permit, no outsider can enter these states. Additionally, those with the permit can only stay for the specified duration, but residents of these states can freely travel to Assam without restrictions.

About AFSPA:
– The British government enacted the Armed Forces Special Powers Ordinance on August 15, 1942, to suppress the Quit India Movement.
– It laid the foundation for four ordinances, one of which was for ‘Disturbed Areas,’ which was enacted in 1947 to deal with security challenges arising from partition-induced internal strife.
– The Assam Disturbed Areas Act of 1955.
– The Armed Forces (Assam and Manipur) Special Powers Act of 1958 followed the provisions of the 1955 Disturbed Areas Act in Nagaland and surrounding areas.
– AFSPA was brought in place for other uses as well.
– A similar act was brought in Jammu and Kashmir in 1990.
Rights under AFSPA:
– Section 3 of AFSPA grants the power to declare an area ‘disturbed’ to the Governor of a state and the Administrator of a Union Territory.
– Additionally, it empowers the central government to deploy armed forces for assistance in the maintenance of civil power.
– The Act provides the Central Armed Police Forces deployed in Armed Forces and ‘Disturbed Areas’ with the right to use force, even causing death, to apprehend any person involved in the violation of the law, without a warrant, and to search and secure areas.
– An officer of the rank of a Commissioned Officer, Warrant Officer, Non-Commissioned Officer, or any other person of equivalent rank in the Armed Forces, after giving a warning, can use force, including the use of firearms or other means, as he may consider necessary for the maintenance of public order.
– The extension of AFSPA is reviewed periodically.
– Once declared ‘disturbed,’ an area becomes a ‘Disturbed Area’ under the Armed Forces (Special Powers) Act, 1976, for a minimum of three months.
